Successful Family Settlement Visa for Applicant Residing Undocumented in the US

Our team at Muldoon Britton recently assisted a client with securing a UK family settlement visa to join her British spouse in the United Kingdom, despite a complex immigration history.

The application was submitted in the United States, where our client had been residing for several years. She originally entered the US as a visitor but had overstayed her visa by approximately five years. As a result, she did not hold legal status in the US at the time of application.

Ordinarily, UK Immigration Rules require applicants to submit their visa application from a country where they are legally resident. Given our client’s undocumented status in the US, this presented a clear challenge to the application.
