The application was submitted in the United States, where our client had been residing for several years. She originally entered the US as a visitor but had overstayed her visa by approximately five years. As a result, she did not hold legal status in the US at the time of application.

Ordinarily, UK Immigration Rules require applicants to submit their visa application from a country where they are legally resident. Given our client’s undocumented status in the US, this presented a clear challenge to the application.

We also submitted strong evidence of the genuine and subsisting relationship with the British sponsor and ensured the application met all other requirements, including the financial threshold.
